Justice in America
The last few words of the Pledge of Allegiance…..”With liberty and justice for all.” Liberty we have achieved. In this country each individual is limited only by themselves. There are no codes or statutes defining one’s place. Your place is what you make of it. This brings us to “justice”. Equality before the courts of law. Fairness for all who enter the hallowed doors of the courthouse. Is that truly the basis of our legal system? Or is it….something else? Many a person has lamented and opined on the color of justice. Prior to the Civil Rights Movement you would have heard people say justice is white. In the era of affirmative action, justice became black. The truth is both of these statements are false. The color of justice is green, as in dollars. It’s not the innocent or the truly wronged that prevail in the courts but the one who can afford to pay the best lawyer. The accused that goes into court with the Public Defender at his side is at a disadvantage. This is by no means an indictment of the PD’s office. These are hard-working men and women who want to see justice served but in most cases they are overworked. It’s hard to prepare a proper defense when you have a laundry list of cases on your desk and limited financial resources. The accused who hires an attorney out of his pocket will have a much better chance simply because that attorney can give his case the necessary attention. But here’s the snag, most people don’t have the money to pay for that lawyer. Many people have mortgaged everything they own to insure their rights are protected. So the major problem is financial. We get just as much justice as we can afford to buy. When attorney’s fees can run into hundreds of dollars an hour and we average $10 per hour, we just can’t afford it on a normal salary. Let’s move away from the criminal side of things because that is just a small part of the justice system. There’s the civil side to think about since this is what impacts our daily lives. We go through life constantly involved in one civil action or another. We just don’t recognize it as such. Since anyone can sue anyone else in America, that's the normal wake up call because you are now forced to come up with the money to defend yourself. Even if you are innocent you could be looking at thousands of dollars to pay the attorney that defends you. A short list of the other legal situations we face include preparing wills, signing contracts and merchant disputes. While most of us can see the advantage of having a lawyer, we don’t use one. For example, a will is one document we will all have a need for sooner or later but how many of us have that will. If you do have a will, have your circumstances changed since you had it drawn up? Have you gotten married? Maybe you’re a grandparent now. All of those situations need to be addressed and your will updated to include them. Have you ever gone to a store and bought something that didn't work? Did the merchant cheerfully agree with you and hand you your money back or did he make you jump through hoops? Have you ever taken something in for repair and it was in worse shape when you got it back? Ever have a cleaner ruin a garment? All of those are merchant disputes. We normally just take the abusive treatment since it's cheaper than securing the services of an attorney. Contracts are probably the one we deal with most. We buy a car, rent or buy a home or maybe get cell phone service. In each case you sign a contract. Now the thing is a lawyer drew that contract up for the other party. What’s in it that’s detrimental to you? What’s left out of it? Is it formatted correctly? All of these are questions a lawyer can answer. So the fact is in America, it’s the lawyer who is the key to the justice system. Unfortunately the key is very expensive.
